Eligibility
You must be at least 12 years of age to use the App. If you are between 12 and 17, you may only use the App with the consent and supervision of a parent or legal guardian. By using the App, you represent that you meet these eligibility requirements.
If you are a parent or guardian consenting on behalf of a minor, you agree to be bound by these Terms on the minor's behalf and accept full responsibility for their use of the App.
Account Registration
To use the App, you must create an account using one of the following methods:
- Phone Number (OTP): Verify your identity via a one-time password sent to your mobile number.
- Google Sign-In: Authenticate using your Google account.
- Sign in with Apple: Authenticate using your Apple ID.
By creating an account, you agree to:
- Provide accurate and current information during registration.
- Maintain the security and confidentiality of your login credentials.
- Notify us immediately of any unauthorized access to your account.
- Accept responsibility for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period.
Description of Service
Elevate Legacy is a mobile application that provides users ("Seekers") with AI-powered conversational experiences featuring representations of historical figures ("Legends") and an AI wisdom guide ("Maya"). The App also includes content such as wisdom tales, quotes, and educational materials.
The App is provided free of charge. We reserve the right to introduce premium features or subscriptions in the future, with appropriate notice. Any future paid features will be clearly identified before purchase.
AI-Generated Content Disclaimer
You acknowledge and agree that:
- No Professional Advice: Content generated by Legends and Maya does not constitute professional medical, psychological, legal, financial, or therapeutic advice. Always consult a qualified professional for such matters.
- Accuracy Not Guaranteed: While we strive for historical accuracy, AI-generated responses may contain inaccuracies, anachronisms, or creative interpretations. Content should not be relied upon as a primary source of factual information.
- Not a Substitute for Human Support: The App is not a replacement for professional counseling, therapy, or emergency services. If you are experiencing a mental health crisis, please contact the 988 Suicide and Crisis Lifeline (call or text 988) or your local emergency services.
- AI Limitations: AI-generated content may occasionally produce unexpected, inappropriate, or incorrect responses. We continuously work to improve response quality and safety.
Acceptable Use
You agree not to use the App to:
- Violate any applicable laws, regulations, or third-party rights.
- Harass, abuse, threaten, or intimidate other users or AI characters.
- Attempt to extract, reverse-engineer, or probe the AI system prompts, underlying models, or technical infrastructure.
- Submit content that is sexually explicit, violent, hateful, or discriminatory.
- Impersonate any person, entity, or AI character for fraudulent purposes.
- Use automated tools, bots, or scripts to access the App or extract data.
- Attempt to circumvent security features or access restrictions.
- Use the App to generate content for illegal, harmful, or deceptive purposes.
- Interfere with or disrupt the App's infrastructure or other users' experience.
We reserve the right to suspend or terminate your access if you violate these guidelines.
Intellectual Property
All content, features, and functionality of the App — including text, graphics, logos, icons, images, audio, software, AI-generated content, and overall design — are owned by myLegacy, LLC. or its licensors and are protected by United States and international intellectual property laws.
You may not copy, modify, distribute, sell, lease, or create derivative works based on any part of the App without our prior written consent.
The Elevate Legacy name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of myLegacy, LLC.
User Content
By submitting content through the App (including chat messages, feedback, and profile information), you grant myLegacy, LLC. a non-exclusive, worldwide, royalty-free license to use, process, and store that content for the purpose of operating and improving the App.
You retain ownership of your original content. Chat messages are processed by AI systems and may be used in anonymized, aggregated form to improve our services. We will never publicly share your individual conversations without your explicit consent.
Disclaimers
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any AI-generated content.
You use the App at your own risk. Any reliance on content provided through the App is solely at your own discretion.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYLEGACY, LLC. (D/B/A ELEVATE LEGACY) AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED ONE HUNDRED DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
Indemnification
You agree to indemnify, defend, and hold harmless myLegacy, LLC. (d/b/a Elevate Legacy) and its officers, directors, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, or expenses (including attorney's fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.
Account Deletion
You may delete your account at any time through the App's Profile settings or by contacting us at support@mylega.cy.
Upon account deletion:
- Your account, profile information, and chat history will be permanently deleted within 30 days.
- Data retained for legal, security, or fraud prevention purposes will be clearly disclosed and deleted when the retention period expires.
- Account deletion is permanent and cannot be reversed.
Termination
We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately.
Upon account termination or deletion, we will handle your data in accordance with our Privacy Policy.
Provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnification, and limitations of liability.
Governing Law & Disputes
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law provisions.
Any dispute arising from these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, either party may pursue binding arbitration in accordance with the rules of the American Arbitration Association.
You agree that any dispute resolution proceedings will be conducted on an individual basis and not in a class, consolidated, or representative action.
Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will notify you through the App or by other reasonable means. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.
